Eugene Quinn was indicted for stealing a letter from the Black Creek mail bag, containing l24 in notes and orders, on the 14th of February last, at Maitland. There were two other counts in the indictment varying the charge against the prisoner, and also a fourth count charging him with stealing a l2 order, tile property of Henry Joseph Cohen; but the last count was withdrawn, and the prisoner was tried for stealing the letter. It appeared that the prisoner had formerly been principal clerk in the Sydney court of requests, but that he had latterly been employed by Mr. Cohen, the postmaster, at Maitland, as a letter sorter. The prisoner said nothing in his de fence, but called two respectable gentlemen as witnesses to his character; but this testimony proved that he had for some time past been addicted to excessive drinking. His Honor then summed tip the evidence, and the jury, after a consultation of about ten minutes, returned a verdict of guilty, and sentence of death was recorded against the prisoner, with a recommendation that he be transported for fourteen years.
